    Default Legal Murder

    My question involves criminal law for the state of: legal murder
    Hey everyone, this is my first post, and just a theoretical question above all, i was thinking about the massacres at virginia tech and columbine and was wondering what would have happened if a student had gotten behind the shooter and say cracked his neck (while he was in the process of shooting innocent people) would this person face any charges?

    Yes.

    A defense of necessity or self defense are issues raised at trial. Even a justifiable homicide is still "homicide" - it just might be rendered lawful per statute based upon the proper defense.

    However, such a person would almost certainly not be prosecuted, and if he were, he almost certainly would not be convicted.

    Even police officers have to justify the use of deadly force.

    Citizens, moreso.

    Homicide is the choice of words and words are very important in law. If you said that At trial the defense would object, in fact entire cases have hinged on that word.

    Uxoricide Killing your wife
    Filicide: Killing your child
    Democide a goverment killing it's people

    homo sapien = homicide,
    infant infanticide. common in India

    Yes, but in the United States we tend to use the term "homicide" to describe any killing of one person at the hand of another (whether accidental or intentional), and "murder" to be UNLAWFUL, intentional homicide. Those other terms aren't found in my state's penal code.

    liberticide - destroying liberty
    femicide- the killing of women (this one is actually still in wide use)

    Under Texas law that who fall under the "He needed killin"' defense.

    Would he face charges?? There is no solid answer, but you can bet it is a resounding NO! However, an investigation would take place, of course.

    The United States Supreme Court has ruled that a Prosecutor, state or federal, has basically unlimited authority to decide whether to prosecute or not, known as "Prosecutorial discretion".

    If a person walked behind the Columbine shooter and killed him, there is absolutely no question this was justifiable homicide. Any Prosecutor who would file charges against the person would say goodbye to his career and he would be the laughing stock of the whole legal community in the country.

    Ther are few exceptions to homicide. One is where your life or the life of another is in imminent danger of death or serious bodily harm and you kill to stop it.

    Another is WAR. Imagine if every soldier who killed in war time would be prosecuted for murder??
