Ajudication

I have a son who is in trouble and I believe that he has been falsely charged on one charge. He has a juvenille record and on both juvenille charges he was Ajudication witheld (it is cleary stated on his DJJ record). When he just got arrested they charged him with " A delinquent ajudicated juvenille". In the discovery the detective says he was not sure if he was a delinquent adjudicated juvenille but he thought he was so he charged him. My question is.. Can they charge him with this if his DJJ record shows :ajudication with held... Common sense to me say NO but maybe I am wrong. Please help me??

Probably not; but laws are different in each state. It may also depend upon whether he had completed the period of probation from the prior charge. If he's improperly charged, odds are that a prosecutor or juvenile court will amend the charge.

Thanks for answering my question. Yes he successfully completed all requirements and I have a release report that DJJ probation terminated and the termination was 8 months prior to this charge. If they amend this charge this will save my son. I am a smart woman and by reading all his paperwork it was common sense to me. I can't believe that law enforcement would charge him with this without knowing for sure. In the deposition the detective states he was not sure if he was an adjudicated juvenille and yet still charged him..I believe all will be corrected very short because I am a fighter for what is right.
