    Default How to Make Record Clean

    My question involves criminal law for the state of: texas
    i was charged with shoplifting a $50 item at walmart, judge put me on probation ,ordered to do Community Service and fined me, my probation period will be over next month and i have completed my service hours and paid all the fine.
    My question is after next month how can i clean my record without the help of attorney, What papers i need to submit and where can i get those??? I do not want this to show up in my background check or record.
    Please help.

    What was the disposition of your case? Were you found guilty and given probation, or did you received deferred adjudication?

    yes, i was guilty (Misdemeanor ,theft property 50=<500) and given 6 month probation with $100 fine and 40 hours CS. I just want to get this off my record once my probation is over. Please tell me how can i do that.
    this was the first time something like that happened to me.i had a clean record.

    Unfortunately, Texas statues do not allow for the expungement of a conviction.

    In Texas, under some circumstances, you may be able to have a criminal record expunged, which means that the records are returned to you or destroyed.

    You may be eligible for expungement if:

    A criminal charge against you has been dismissed, you have been found not guilty, or you have been pardoned; or
    Someone used your name or identification when arrested (identity theft); or
    You are a juvenile who has completed a deferred sentence; or
    You are an underage drinking first offender.

    You're not eligible for an order of non-disclosure, either. That's only for people who complete deferred adjudication programs, which you did not.

    i want to open this thread again. I checked with the court today,I was given deferred adjudication. and i can apply for order of nondisclosement OR expunge. Please tell me what should i choose, ?? can i apply on my own without a lawyer? if yes what paper work i need to do?

    If you fulfilled all of the terms of your deferred adjudication, you may file for an order of non-disclosure. Obviously, you'll need to get the forms relevant for your county from your County Clerk of Courts.

    You don't note your specific charge here, so it's impossible to tell if you have expungement available to you. If you were charged with a Class C misdemeanor, you do. If you were charged with anything else, you don't and you must go with non-disclosure.

    In any case, the proper forms for whichever avenue you have open to you are available from the Clerk of Courts.
