    Default Texas Child Supt Modification

    My Ex pays $1200 a month in child supt for one child. He was laid off Nov 1 and wants to modify his support to reflect his unemployment income only (thru Mediation). He was making over $120K a year and has been for about 12 years. Can he only have his unemployment income considered?? He lives in a 400K home(he got the house), 2 Cars, Motorcycle and lots of stock from his former employer. I am considering not agreeing to a reduction thru mediation, and letting him take me to court and let the judge decide what is fair. He is saying he only gets $350/week unemployment before taxes. I don't think that fairly reflects all of his assets, and I don't feel he should get to keep everything and just get out of his child support obligation. Am I way off?

    Default Unemployment

    His period of involuntary unemployment may be considered by the court. The court can also consider his employment prospects in determining if income should be imputed.
