    Default Post Overseas - Legal Way to Not Go

    Hypothetically: E-7 in the army just returned back from duty overseas for 1 year. Going through divorce with multiple small children ages 2-6. Do not want to leave again for a post that is in Europe and 2 years long. Family not allowed to come with. Legal ways to get out of position- DO NOT want to get out of army but need time with family in States.

    Are there any ways to petition or file to stay in States for period of time?

    You could try for humanitarian reassignment. Apparently the Red Cross can advise:
    Quote Quoting Humanitarian Reassignment and Hardship Discharge:
    If a hardship exists within your immediate family that cannot be resolved by an emergency leave, the Red Cross can counsel the family or service member on how to request either a humanitarian reassignment closer to home or a hardship discharge. We’ll help you understand the procedures and documentation needed. Final decisions on these applications are made by military authorities.

    You can go through your command and request a reassignment due to hardship reasons. You will have to list those reasons in your request.


    depending on how much time has been served. If it is 20 years or more just retire.
