    Default Getting a Divorce from a Deported Spouse

    My question involves divorce in the State of: North Carolina

    Question: I married an undocumented immigrant (illegal alien)
    He is going to be deported soon and I want to divorce him. In the state of NC, the married couple must have one year of legal separation before they can get divorced. Does that rule apply to an American born citizen married to an illegal immigrant?

    Yes it does.

    After his deportation, you'll still need to wait to file, but then you should be able to file for an uncontested divorce.
