Probation Violation for Positive Drug Test

My question involves criminal law for the state of: Ohio

I have been on probation for a DUI since 9/30/08 and have been getting drug tested twice a week for cocaine and pot since I tested positive at my first appt. On 10/20 I tested positive again for cocaine, and just got the papers for the oral hearing on my probation violation. I do have an addiction problem, but have since been clean (going twice a week) and my hearing is in a month. Is there any way I won't get the 54 days that were suspended? Is there anything I can do to help myself (besides staying clean) stay out of jail? HELP!

Hire the best lawyer possible. You should also take proof with you regarding what your doing to treat your addiction, meaning if your going to meetings, get a paper signed. If your seeing a therapist, have him/her write something up saying that you are actively seeing them and haven't missed an appointment. If you have a job, ask your employer to write a letter. Even with this, it's a crap shoot. It doesn't look good that you lasted a whooping 20 days before you got busted and it's been just over 30 days now. Although, it is an accomplishment, the courts see this day in and day out. If your willing and able you can ask the court if you can enter treatment. I do hope you find a way to KEEP clean as the addiction creature eats lots of people.
