    Default Ohio FRA Suspension and Driving Privileges

    My question involves a driver's license issued by the State of: OHIO

    Hello,
    My license are suspended for not showing proof of insurance. The Ohio revised code says

    (b) If, within five years of the violation, the person’s operating privileges are again suspended and the person’s license again is impounded for a violation of division (A)(1) of this section, a class C suspension of the person’s driver’s license, commercial driver’s license, temporary instruction permit, probationary license, or nonresident operating privilege for the period of time specified in division (B)(3) of section 4510.02 of the Revised Code. The court may grant limited driving privileges to the person only if the person presents proof of financial responsibility and has complied with division (A)(5) of this section, and no court may grant limited driving privileges for the first fifteen days of the suspension.

    Now i was told today that my first suspension was 7-30-03, and my 2nd suspension on 7-30-08. Which to me is 5 years apart.
    I was told it was not. I also found this in the Ohio Revised Code


    1.44 Week - year.

    (A) “Week” means seven consecutive days.

    (B) “Year” means twelve consecutive months.

    Effective Date: 01-03-1972


    1.45 Time computation.

    If a number of months is to be computed by counting the months from a particular day, the period ends on the same numerical day in the concluding month as the day of the month from which the computation is begun, unless there are not that many days in the concluding month, in which case the period ends on the last day of that month.

    Effective Date: 01-03-1972

    So according to the 1.44 law "12 consecutive months is a year"
    And according to 1.45 the period of a month " ends on the same numerical day" not the next day past as they are trying to tell me.

    Am I looking at this correctly?

    Thanks anyone for any help, I really need work driving privlages, I am a father of 3, and sole provider to my family!

    They don't actually appear to be disagreeing that your suspension ended on July 30, 2008; but you believe that means it ended at 11:59:59 PM on July 29 while they argue that it ended at 11:59:59 PM on July 30.

    Exactly..how would I go about arguing this? Does anyone know of a good lawyer in the Cincinnati area?
