Apparently in Virginia the maximum penalty for reckless driving is one year in jail, a $2,500 fine, a six-month suspension of driving privileges, and 6 demerit driving record points. That's pretty harsh, even before considering the effect on insurance rates. Still, for a first offense involving only speeding, jail time is extremely unlikely. A local traffic ticket defense lawyer (one in the county where the ticket was issued) should be able to advise you as to what deals or defenses may be available to you. (It appears that, due to laws like this, Virginia has a proliferation of lawyers who offer defense services for reckless driving charges.)
You don't give your home state and that is very important. The result will be reported back to your home state and it depends on how your home state treats the result. It is a mandatory court appearance and a criminal offense so you either have to return for court or hire an attorney. sorry, my home state is pa. there, this type of speeding offense would be five points - no suspension, hearing, etc. for reckless, pa has discretion - they can suspend or revoke. in this case, if i'm convicted on a reckless (for just a speeding offense) in va, would it be treated in pa as reckles or speeding?
i posted this in another thread, but i spoke to two lawyers who told me that since i'm not from the state and appearance by me is not required if i get an attorney, i face no possibility of jail time (if i hire an attorney). is this accurate, from what you're aware?
