    Default Adverse Possession

    My question involves real estate located in the State of: Oklahoma

    The landowner of 20 wooded acres that meets my place had his surveyed a month ago,and according to their markings part of my fence goes 15' onto his property.I have lived on this property for seven years & have talked to the previous owner that said they lived here for the previous nine years.And the fence was in place when they bought it.There has never been any question of the property line before.Will this fall under the Adverse Pocession Law?

    You may have an adverse possession or acquiescence claim; 16 years would be long enough to satisfy the statute of limitations if all other elements are met. (For a discussion of adverse possession law in Oklahoma, read this.) But assuming you do, it doesn't sound like your neighbor is going to happily deed the land over to you, so I suggest you get your case reviewed by a real estate lawyer and decide if it's worth taking your neighbor to court.
