    Default Statute of Limitations for an Arrest Warrant

    My husband had a warrant for his arrest in Missouri. He was arrested here in TN a year ago, was released because Missouri did not come get him in 10 days. He was just arrested again for the same thing. Is there not a statue of limitiation for extradition warrants?

    Default Arrest on Warrant

    Your husband should get credit for any time served during these periods of detention, when he is ultimately sentenced on the underlying warrant. If he wants the warrant to go away and Missouri doesn't come to get him, he should consider hiring a criminal defense lawyer in Missouri to negotiate a plea deal, then going to Missouri to enter his plea. (Of course, it's possible that Missouri will come to get him this time.)

    I found out the last time he was arrested on this warrant, they did not want to come get him. Is it possible missouri would just the heck with it and not come get him. And would we go through the same stuff with him being arrested or would it just stop. Could Missouri just say the heck with it, and not do anything.

    Default Interstate Warrant

    If they don't want to come get him, they really shouldn't have entered the warrant into the interstate lein system.

    That's what I don't understand. The sherrifs dept told me the last time they didn't want to come get him. The sherrif told me the warrant they have now is the one he was arrested on a year ago. Isn't there some sort of statue of limitations on warrants.
