    Default Death of Owner Quit Claim Not Filed

    My question involves real estate located in the State of: nj
    In 1996 I divorced my husband. My divorce papers state that I would sign a quit claim deed from our martial home, which I signed and gave him, . It also states my ex would then get a new mortage in his name and a new title. We haven't communicated for 8 years. He died last week, Nov 2008. I just found out that he had done niether. I was on the mortgage until it was paid off in Aug 2008. I am still on the title. I don't believe he every filed the quit claim paper. Do I still own the house? Can he leave it to someone in his will? Wolud I be responsible for the taxes? I live in Orlando, FL The house is in NJ

    You don't really have any claim to the house. The mortgage is paid off so that question is moot. The quit claim can be filed now as it is still valid.

    If it is filed after his death and then willed or sold, would I be responsible for any taxes, as I was listed as an owner all this time?
