Default Bank of America
My question involves collection proceedings in the State of: NH
My husband was out of work for almost two years due to an injury that happened at work and needed two surgeries.During that time we were only able to pay our mortgage and home bills,we were not able to pay the credit cards.Just yesterday we got a summons to go to court and they are going to put a lien on our home for the monies owed. Is there anything I can do legally or make some type of payment arrangement? We have tried to talk to Bank of America several times before but they just want their money.

Hopefully one of the financial guru's like Betty will respond. My understanding is they can put a lien on your home but cannot foreclose, force you to move, raise your payments, etc. The lien sits there until the house sells.

As you've been sued, you will want to be sure to answer the complaint in a timely manner, raising any affirmative defenses that may apply (e.g., the statute of limitations). You are free to discuss the case with the plaintiff's lawyer and to try to settle the case or enter into a payment plan.

Depending upon the magnitude of your debt and your ability to repay, you should consider consulting a bankruptcy lawyer.

I agree with everything Mr. Knowitall said. I don't know who you have been talking to at Bank of America but you need to talk to the plaintiff's attorney (as suggested by Mr. Knowitall) to see if they will settle for a lesser amt. and/or set up a payment plan.
