    Default Roommate Not Paying

    My question involves a roommate in the State of: Virginia

    I own my house and a friend is renting a room from me, so I guess I am the landlord correct? She has not paid rent for a few months and it now be on the point of saving a friendship. I wasn’t sure if me (the landlord) living with the tenant would change any thing?

    I wanted to server her with a 5- day "pay or quit" notice, is this the correct thing to-do? If so, can I write it up hand it to her and have her sign with my Husband as a witness?

    After these 5 days if she has not left, I then go to the general district court to apply for Application for a Summons in Unlawful Detainer, with proof that I gave her the 5- day "pay or quit" notice.

    From there we both get a court date..

    Without see the laws on rentals in VA I can say what you desribe is normal proces for removal of tenant
