By the way the buyer already deposited the money in escrow.
If the real estate agent signs a contract, and has no authority to do so, it will typically be possible to get out of the contractual obligation. The real estate agent might end up being sued by the buyer, and may lose her license. (It also may be a criminal offense, depending on state law.)
If the seller gave permission for the agent to sign, knew of the agent's signature and acquiesced to it, or if the agent's signature is on an ancillary document while the seller signed other sale documents, it becomes less likely that the agent's actions will be a basis to get out of the contract.
This is something that should be evaluated by a local lawyer, who can review the contracts and signatures.
Well my mother signed the counter-offer, but some of the other papers the real estate agent forged, and she basically tricking her. We found out that there were 2 of the same copies both master, one with a signature and a date, one with a signature without a date. Thats how we caught her. But she is a very close friend of my mothers and she doesn't want to hurt her, yet she wants to still keep the house. What can we do? I dont want ther to go to jail, but we still want the house.
Discuss the situation with the agent, and see if she can figure out a way to extricate your mother from having to sell.
She's not cooperating with us
