My question involves workers compensation law for the state of: I have been on work comp for one, and a half years. I had a double fusion to my neck. I was told by Doctor that I have perment nerve damage. I'm right handed, and the nerve damage is to my right hand. I drop things all the time, and I can't feel things resting in my hand. Also I have tingling in all five fingers. Enough about the injury, and to the Question. I was released to work with restrictions 30 pound max lifting, and at 1/3 of the time. No commercial driving, thats because I'm a truck driver. My employer offerd me employment what he seems, and the Comp company seems to think to paint, sand, and re-stain his deck, as restricted work. The deck is around his personal home, but he has an office in the house that he runs the buisness in. All this is taking place in the state of Missouri. I told the comp company I can't do that type of work, and my attorney knows this also. I was told that my benifits have ended because I didn't take the job unti I see the Doctor to ask him about the meds that I take for nurve problems. The meds causes dizziness, and I don't know what I can do, and what to avoid when working. I've asked for an appointment with doc, and asked the comp company for that appointment. Question: Should I get benifits while waiting for appointment with doc? or do I still need to show up and paint this deck? I tried to sand a board at my home to see what I can, and can't do. My injury got worse from that work I did at home. Question: I requested to see doc again, and advised comp carrier about this situation sufferd at home, and requested a visit with doc. Does comp company re start benifits? or is this all taking place without TTD payments? and can comp company hold the injury substained at home against me? I was within the the restrictions set for me. What does sand paper weight. Ha! Ha! I've not yet ended the comp case, I still need to see another doctor for my disability rating, and for final release MMI. Question: I've asked for Voc rehab training, and my lawyer said don't do that now, but wait until we fix this situation. Is he right? I'm not getting benifits any longer, and it's going to be a fight. Any help with all, or part of my situation will help my knowledge bank, and help me to understand what to exspect.
