My question involves employment and labor law for the state of Texas!
I just moved to TX and started a job where I am payed a percentage of my service sales or a flat hourly rate (whichever is higher by pay period) and my boss has suddenly upped my weekly schedule from 40 hours to 55. He told me to keep track of my sales, for if I were not making commission he would have to cut me back to 40 hrs so I wouldn't receive overtime.
Are commissioned employees not entitled to overtime? Does 'full-time' in TX equal 40 hours? I was never informed that I would have to work more than 40 hours a week at the time of my hire.
What are my rights?
