    Default Forgot to Display Disabled Placard, Will an Appeal Be Successful

    My question involves a traffic citation from the state of: California
    I received a $437 ticket for parking in a disabled space without displaying a disabled placard (it was sitting on my seat, I forgot to put it on the windshield!) Can this be successfully appealed since I am disabled and I do possess a placard?

    The CA vehicle code I was cited for was 22507.8(a) "It is unlawful for any person to park or leave standing any vehicle in a stall or space designated for disabled persons and disabled veterans pursuant to Section 22511.7 or 22511.8, unless the vehicle dispalys either a special indentification license plate issued pursuat to Section 5007 or a distinguishing placard issued pursuant to Section 22511.55 or 22511.59."

    Okay.

    In theory, you violated the section and can be held liable for the violation. No placard was displayed.

    However, it has been my experience that if you can appeal the citation and present your placard and the registration paperwork that shows the placard was issued before the date of the violation, the violation will often be dismissed. This is not universal, however, but seems to be the case.
