    Default Selling Parent's House

    I am Durable Power of Attorney for both parents. They have been in Skilled Nursing care for over a year. I am selling their house to pay for their care. THe house is in my mother's name only. There is no mortgage on the house. My brother is losing his house due to financial problems on his part. He is considering moving in my parent's house "rent/lease free". Is this legal?

    Is what legal? For you to sell your parents' house based on the power of attorney? Read it and see if it grants you that power. For your brother to move into your parents' house, and not pay rent? Why would that be illegal, assuming he has their express or implied consent, or if you allow it to happen?

    How to you intend to pay for their care if he moves into the house? In my book your parents come first.

    They will have no money to pay for their care if the house is not sold within a reasonable amount of time. My sibling has already spent over $17,000.00 of my parents money within a year, in addition to other loans that have not been repaid. I have no hope of ever getting the money back/repaid to pay for my parents care. Thank you for your reply. I appreciate all help!

    Is it LEGAL for him to move into a house that he does not own Mr. Knowitall.

    My sibling does not have the money to pay rent or lease my parents house, Mr. Knowitall.

    Why would that be illegal, assuming he has their express or implied consent, or if you allow it to happen?

    He does not have their consent and does not have mine either. They are not mentally able to make business decisions of any kind.
