    Default Working Out of State and Custody of Children

    My question involves a child custody case from the State of: Arkansas.

    I have a modification of custody filed in Arkansas over my 3 children. The grounds are based on my ex having a married overnight guest openly stay, He is still married but is also the the person she was having an affair with while married to me. The childen's wishes are to live at my home full time. She also has been kicked out of the children's school and has to recieve permission to enter their building for being a disruption. I have a report from a theropist that has identified the youngest being touched sexually by other youger members of my wifes family, and she has failed to comply to several court orders that now place her in contempt.

    I have taken a job that is paying 6 figures a year but requires me to be away from home while I am working and in the next state. I have remarried and my new wife takes the children to and from school when I am not at home. My ex tells me that her attorney feels that since I am working out of state, I have blown any chance of winning this custody battle. Have I hurt myself?

    Any time that your ex's attorney says something, you should take it with a grain of salt, AND talk to your won attorney about it.

    You might, or might not have hurt your chances, there's no way of us knowing. Your attorney will be the best one to tell you if you have or not.

    Weighed against what you're reporting as the circumstances being confronted by your children while in the care of their mother, I'm hard pressed to imagine how moving someplace else and making more money will have a detrimental impact on your custody case. Ultimately, the court will determine what is consistent with the best interests of the children.

    Given what you're claiming against the mother, you should not delay in petitioning the court for modification of the parenting plan.
