    Default Can You Sue a Homeowners Association Board

    My question involves real estate located in the State of: Florida
    I called the HOA to request a tree be taken down in the greenbelt area because of upper tree limb damage which could possibly cause damage to my home. I ws told by a board member the tree in question will fall away from my home & he didn't feel comfortable taking it down. I then asked if that meant they will be liable for any damage & he said yea (sarcastically). I sent a registered letter to the association & every board member informing them that they were now iable for any personal injury & or property damage. My understanding is that at the last monthly meeting they scoffed at my letter saying more or less I couldn't hold them liable. Can I sue them if the tree in question causes any damage?

    A: Anyone may sue anybody for anything at any time anywhere.

    You would have a perfect case against the association should the tree causes damaged to your property. You also can sue the association to force its to trim the tree to a safe level.
