    Unhappy Red Light Violation in California

    My question involves a traffic ticket from the state of: Callifornia

    Hi, I happened to get citation for red light violation. I was at the intersection of the freeway and normal road. (I was on the normal road) I saw the cross signal has just turned red from far behind the limit line, I steadily hold my brake while approaching the "limit line." I saw the light on my direction was still red, so I hit the brake and tried to stop, and then while I did it, the light on my direction turned green. So I let go of my brake and continued driving. After one entire block, a police pulled me over. The first word came to me was in an assumption that I was drunk driving, then I said I didn't drink, and the police turned the topic over to the red light violation issue saying I did not wait behind the limit line until the light turned green. I would like to appear the court to see if there's possibility that I can get a rid of this ticket, because I really think that I didn't violate the rule of red light violation. Or is there anyone that can state the red light violation for me please?

    I ask everyone when I stop them two fundamental questions.

    1) When was the last time you drank any alcohol?

    2) Is anyone on probation/parole?


    Are you saying that you stopped your vehicle past the crosswalk / limit line while the light was red and then proceeded through the intersection after the light turned green?

    21453. (a) A driver facing a steady circular red signal alone shall stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown, except as provided in subdivision (b).

    Shall stop is a must, or you have to stop prior to the limit. I dont see much of a defense to the citation other than the Officer's perspective of the intersection and how the Officer knew the light was red at the time.

    Where was the Officer in relation to the intersection? Was the Officer's view of your limit line unobstructed?

    I was far behind the limit line while I just passed an intersection, and Yes, the traffic signal of my direction was red. I did hold the brake and slow down my car approaching to the limit line while it was still red, and then when I was about to hit the brake at the limit line, the signal then turned green, so I let go of the brake and proceed through the intersection.

    I believe the Police Officer's car was behind me
