a few questions. I want to marry my boyfriend. He has no papers, no s.s. card. Can we just go to the court clerk and get a marriage liscense or what procedures do we need to do to make it right? Also how do we get him a s.s. and how long does it take?

You can check with the County Clerk, but depending upon where you live you may find that you don't need to submit a social security number, or can submit some other form of identification for your fiance. However, if he does not have a valid visa, you should be aware that you cannot shortcut or avoid the immigration process by getting married, nor would marriage at this point help your fiance avoid any consequences of any illegal presence in the country. He would likely benefit from consulting with an immigration lawyer about his situation.

my boyfriend has a social security card but no other form of id. his only other id is an expired authorized employment id. we could send for his birth certificate. do you think they would accept the expired id?

The County Clerk will be able to tell you what ID they will and will not accept.

If you decide to get married, and your boyfriend was admitted and inspected when he entered the U.S., he can apply for Adjustment of Status, and get his Green Card. However, if he entered without inspection, he cannot adjust his status. The only exception that exists is that if before May 2001 an 1) Employment-based Petition; 2) Labor Certification; or 3) Relative Petition was filed on his behalf.

What do you do if he cannot adjust? You may marry him, but then he'll have to go home and file a waiver to come back (due to his unlawful presence - 3/10 year bar).

In order to advise on SSN, one should know his exact immigration history and status. In general, one should have a legal status to apply for a SSN.

I just married my husband on December 23rd and he is an illegal immigrant. Where I live in California a Social Security is not required and they marry them every day. Call your County clerks office and they'll tell you if it's required. Good luck!

it seems like there are quite a few people (male/female) who are in the situation of wanting to marry an illegal. Myself included. it's a no win situation. you're able to marry the one you love only to have them ripped away from you for nearly a decade. both partners need to evaluate if this is what's best for them. don't expect any help the american govt/courts. it's made to be this difficult to discourage the practice. i can't beleive immigration would voluntarily tear apart a family. they don't care if you've got kids together. this is an issue that should be readdressed by the govt. i'm sure there are millions of couples in this country facing the same dillema. good luck, get an attorney, and don't stop pushing. remember the squeky wheel gets the grease.

If he's here illegally and he leaves, he may end up facing a lengthy period of exclusion from the country (which is also true if he stays and is ultimately deported). He should consult an immigration lawyer about his situation.
