    Default Damaged Property

    My question involves criminal law for the state of: Oklahoma


    I recently got into a domestic dispute with an ex. Long story short she hit me repeatedly, kicked me in the groin, and destroyed a couch, love seat, my phone, and an expensive guitar. I called the police. They came out and took pictures of me and my damaged property. The state is pressing charges for domestic abuse and my question is do I need to file seperate charges for the property damage? Is this a civil matter? because it occurred while she was committing a crime so I would think I have the right to press some sort of charges against her. Her arraignment date is today. Is there any way I can find out if the judge will order her to pay me back?

    The property damage would be a civil matter. You'll need to gather up your evidence (including receipts if you have them or estimates if you don't) and pursue a claim in small claims court.

    Is there any way I can find out if the judge will order her to pay me back?

    Less cheekily, no one here can tell you what any given judge might or might not do. We're not in the business of trying to make predictions. The only way to find out is to file suit and present a solid case.

    If she's convicted, whether by plea or after trial, you can ask for restitution and see what the judge orders.
