SSI for a Stepchild

Hi again,

I was reading one of the posts here about who is lawfully allowed to receive any Soc Sec benefit if one of the parents died. My husband passed away a year ago. My husband treated and provided everything for my daughter even if its not his biological child. He wasnt able to legally adopted her but we were supposed to do it but he passed suddenly. My daughter is not getting any SSI from him because they said, she wasnt adopted. If that is the case, I am confuse now why SSI denied her in receiving the benefit since she is considered as a stepchild.

Please enlighten me.

Unmarried children under 18, or up to age 19 if they are attending high school full time. Under certain circumstances, benefits can be paid to stepchildren, grandchildren, or adopted children.

Did you ask the SS people if you qualify for those certain circumstances? It is very rare that this is granted.

When SSA were processing my, my daughter's (one whose father died) last year, I included the name of my eldest daughter. They asked me for an adoption papers to show that she was legally adopted so she could also receive the benefit. Obviously, there was none. The last option that they could do to be able to grant my eldest daughter's benefit was they were looking for my deceased hubby's at least 2 yrs tax return to show that he really supported her. Since he has probs with his previous tax returns and did not even file the previous 2 yrs before his death, I, again cannot provide anything for them. I cannot even provide any paystubs from his employer since I feel like the SS will ask me why he did not file his returns the fact that he was receiving a paycheck. Since that issue was taking longer for SS to release my and my daughter's benefit including the back-pays and I really needed the money so bad, they denied my eldest daughter's benefit then.

My eldest daughter's bio father never given any CS. He is from another country.

Your claim isn't going anywhere unless and until you can provide some documentation that the step-father supported your daughter. As it stands, you are telling us that you haven't been able to provide any such evidence.

No estate was ever opened? Then open an estate, have the administrator complete and file his tax returns, and then you'll have tax returns. Whether the Social Security Administration will find them convincing, I can't say.[FONT=verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif] But it's better than nothing.
