Non Custodial Parent 5hrs Late Returning Child

My question involves a child custody case from the State of: Ohio
Mother is non-custodial parent. She is ALWAYS late dropping off the children she is the custodial parent of and is never home when the child my husband is the custodial parent of is brought to her. Lately, she has been stating she will be bringing the child my husband has custody of back to us but is always over an hour late. This past time she brought the child home at 11pm. The time that is court ordered for exchange is 6:30. This was also a school night when the childs bedtime is 9:00pm. Is there an emergency complaint we can file to stop visitation until something more firm is in place or something is done to prevent this from happening?

No, he cannot stop visitation until the order has been modified. Until then, he must comply with the order.

What I would suggest is that maybe he should go pick the child up if you all don't live too far away.

That is how it is supposed to be, but she always has the child out somewhere and is never home. She just returns the child whenever she is done with wherever she is at and passes through. This is a every other weekend occurance and every weekend she is late whether she's supposed to be at her own home to receive the child or at ours to drop the others off.
