I am seperated with my husband and would like to move out of state. The 2 kids are with me and he takes them when hes not "busy" or playing poker. I am tired of his BS and want to start a new life in a different state. What are my options and how can I go about doing this without legal issues standing in my way? The divorce is going to be hell and I know he will fight me about moving away, that is why I need to know if I can do it while we are still married?

Technically, since nothing has been filed, you have the right to move with the children.
However, if you do so, your husband will have the right to file and request the court to order you to bring the children back, which would likely cause big problems for you.

The best way to do this will be for you to file for the divorce before you move. You can request that the court allow you to remove children, but you'll need to prove that it is in the childrens' best interests. (hard to do).
