Default Parents Rights
My question involves paternity law for the State of: Texas

My husband had an affair and a baby was born. His name is not on the BC but, the child has his last name. The child's mother is on drugs, no permanent address, and has been in and out of jail. My husband recently started using drugs again.

Can I do anything legally to take custody of the child?

Unless the mother is willing to give you custody, no. You can call CPS and report the abuse. You have no legal rights to this child whatsoever.
