    Default Expungement of a Bad Check Charge

    I recieved as class c misdemeanor for a hot check. this is my first offense. I have paid it off and was told that I can have it dismissed. Once I get it dismissed I want to get it expunged because my job did a background check once they did a take over with another company and it showed up as pending misdemeanor for theft. I want to know how to go about getting it expunged and how long will it take to get it done. the company is holding my job until they get proof that it has been expunged and I am affraid that it may take longer than 2 months to have it done. Can anyone please help me with this issue

    It sounds like you probably received deferred adjudication. You will not be able to apply for an expunction until you complete the probationary period. After that, you can file for the expunction immediately, but your case will take at least 30 days to be heard as the court is required to give that much time for the state to object. Often you can get it sealed using an order of non-disclosure must quicker as you don't have to wait the 30 days and can get it done before a JP or other lower court instead of district court (where an expunction is filed) which is often busier. I've seen non-disclosures completed in a matter of weeks. However, your company may not honor the non-disclosure (esp if it is a financial company.) Have you completed the probationary period yet?
