My question involves civil rights in the State of: Personal consent

For an assignment I have been asked to critique some ethical based questions and I was hoping someone else might be able to add more input.
Scenario:
Some researchers want to take saliva from the bottles of runners after a running event downtown for analysis of their genetic information. However the runners will not know that they are actually part of a study, in order to maximize participation.
This is [U]actually[U] against the law correct? Is there actually a law against this?
If there is what exactly is it? Is it because participants are not giving informed consent?
