    Default Back Taxes, Child Support and Tax Refunds

    My fiance owes over $12000 in child support arrears because the BM was on public assistance. In the last 5 years he hasnt filed any tax returns, he has some w2's but not all. is it possible to file the tax returns and get what ever refunds there may be to go towards the child support arrears. He was never on a high income, but it might go to in some way lessening the amount owed???

    No offense intended but your fiance seriously screwed up. He absolutely does need to file the returns (unless his income was less than about 8000.00 per year) but he has lost the opportunity to get a refund for any year earlier than 2005.

    That is really a shame, since the money could have reduced his arrearages. However, 2005, 2006 and 2007 refunds can still reduce his arrearages, but 2005 will drop off on April 15th, 2009.

    If he contacts the IRS he can get income transcripts for the last 5 years which will show the same information that his W2s would have shown. That will cover him for the feds, but not for the state if he lives in a state with income tax.

    yes he screwed up i'm sure he doesnt need you to tell him that, also you dont know the situation that allowed that to happen. why are people so aggressively opinionated on this site.

    the other poster attempted to be nice about the statement yet you return and chastise. Fine. How about this then.

    Your fiance has no reason that is acceptable short of being kidnapped and held against his will for not filing tax returns. He did screw up, big time. If he ever does file his taxes, there will be interest and penalties tacked on that would eat up most, if not all, of any small returns. Whatever is left will be intercepted by the CS office to pay on your fiances arrearages.

    $12k is a lot of money and could get him tossed in jail for failure to pay especially since he owes the state, not the mother of his children. The state does not need the mother to initiate contempt charges to take action in this situation.

    There, now you can look at the other posters info and not feel so offended by it due to the rough nature of mine in comparison.

    Feel better?

    Oh, and there are penalties and interest that accrue on the deliquency as well so small payments do not tend to reduce the total much.

    to any other posters, ( as this thread has been edited) there are no bench warrants, because the person in question has not been avoiding paying child support all issues regarding the child support are currently being dealt with. like i said thanks for you concern. duly noted.
