    Default Chapter 7 and charged off accounts

    I'm preparing my Chapter 7 paper work and pulled a merged credit report to make sure I don't miss anything. Navy Federal Credit Union is one of my creditora who I had a CC and consumer loan with...the credit reports lists both accounts as "closed" and "charged off" but I still get calls (from Navy federal, not collector) and letters trying to get money and recently even threatening a lawsuit.

    Should I put NFCU and the relevant accounts on my filing even though they are listed as "charged off" or not?

    Default Including Creditors

    Yes, you should include all known creditors. The fact that somebody has administratively declared your debt to be "charged off" prior to the expiration of the statute of limitations for enforcing that debt is of little significance - that creditor likely remains able to enforce the debt as a valid obligation. If the creditor is not included in your list of creditors, that debt won't be discharged in the bankruptcy proceeding.

    If you have not done so already, you should speak to your bankruptcy attorney about whether the pending federal bankruptcy reform legislation is likely to affect your situation. That legislation, as drafted, will apply to all Chapter 7 bankruptcy cases which remain pending at the time it becomes effective.
