My question involves criminal law for the state of: Missouri


Hello,

I got an SIS for a dwi charge in February and was put on 2 years probation. I'm done with all of my satop and service, and the VIP etc...

I asked my probation officer if I could leave town to go to a music festival, and she said yes and to come see her on Monday morning when I got back.

So I go see her, take a pee test and I pass.

The next week I go in for my monthly meeting and I am asked to take another pee test. I failed it, came back positive for THC. She has filed a probation violation and I'm waiting for court material in the mail.

So, when I go to court, I guess I'll be convicted of the DWI, and all of my money (for SATOP and VIP) will be gone from me.

My question is:

If I go in and proclaim that my religion is RastafarIan, and I used marijuana in a Ritual fashion, am I still going to be f'ed?

Constitution - Amendment I - Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof....

Truth is, I do identify myself as a Rasta. I am growing dreadlocks and I am knowledgeable about the religion. Could I come out on top and not be put down by the man for partaking in a sacrament (marijuana) of my religion?
