Default Out of Control Youth
My question involves juvenile law in the State of: Cali.

My son will be 18 on 12/8. I have posted many threads about my problems with my son. Well it has happened. He tried to assualt me on sunday. threathened to have my boyfriend jumped. I called the police and they did nothing. Told him to take a walk. They told me when he does hit me then they will take him. I am scared cause the more he gets away with the further he will take it. 2 weeks ago he told me I better get my casket picked out cause I am going to need it. He has mental issues and should be on medication but the police told him I can not make him take anything. I am really scared. His rage is getting worse. Please is there any help out there for me.please.

Update:

The police just picked him up for threatening me but told me as soon as they release him I have to pick him up. He also told the police I was going to pay for having him arrested. How can they put him back with me after he says he is going to get me. I am so scared now.

The police are wrong until he turns 18

The good news (well sort of)-
You can make him take medication due to him being a minor. You can
get the PD to do a involuntary hospitalization (5585 Welfare & Institutions
code) due to him being a danger to others

The bad news-
Is that when he turn 18 he is considered an adult in the eyes of the law,
you can get the PD to do a inlvoluntery hold (5150 W&IC) for him being
a danger to others

You cannot make him take meds but a MH court can
do that, if necessary

Thank you for your response. Juvy called me yesterday and said they are holding him until thursday unless they get over crowded. I am praying they keep him unitl court. I did find a suicide note in his room. He writes these all the time. He is always telling people he is going to kill himself he does not get his way. I am going to take this note to court on thursday and give it to the Judge. Hopefully he will have him evaluated.

Here is an update: Went to court the Judge does not want to allow him back in my home since he is threatening to hurt me. He pleade guilty and will be sentenced on the 16th which the probation dept told me he will be released back to me. The commit is he is almost 18 just deal with it. I showed he several years of documentation of my efforts to get him help and all his violent behavior. She seemed to not care that he has the potiental to hurt someone. I guess I am going to have to beg the court to please consider mine and the saftey of all others.

My wife and I have just gone through a similar situation. Zach threatened suiside in may, we forcibly had him put in the hospital on 6/1 He turned 18 on 6/8 and signed himself out on 6/13 No meds no follow up He was veerbally abusive to us but did take him back in the house in mid July..Cut to end of Sept, he was arrested for assault, resisting and disorderly. The police sent him to the hospital He was released a few days later. That evening the police were called by Zach ex girlfreind stating Zach was going to harm himself. Boght him to another hospital. I could go on,but let me cut to getting an order of protection out against him more for his safety because of his refusal to get help.. He is now at Dupage County jail.. We have been told not to bond him out. He,s been there one month the hardest month we have ever had. There is a program called MICAP(mental health court aternative program) which forces the accussed to go to therapy and take prescribed medication or face jail time. Last fro 12 to 36 months
Our son still might refuse this because he does not want to take meds or be labeled mentally ill. Did I say this has beeen the worst month in our lives. Get support so you can take care of your self. Your son is not simply out of contol there is a mental problem. Talk to NAMI national association for mental illness for support and guidance. Take out an order of protection so at any time the police have to arrest your son no questions asked. It hurts the inside real bad but you have to take care of yourself.

Thank you so much for your reply... He has been in jail since Sept. 29th, and I have reframed from contacting him. He has sent sweet letter in the begining but they are now threatening in manner. I have court this thursday the 13th and I am scared out of my mind. I dont eat or sleep. The last 2 court dates he blow up on the judge and I. At this point his behavoir is whats keeping him in jail. The public defender told me that when he gets out for me to protect myself, change my locks, get an alarm, ect. He will be 18 on Dec. 8th and they courts have told me thats the longest they can keep him for my safety but when he is 18 he will most likely be released. They are going to offer him a volunteery (sp?) program but most likey he will refuse because he thinks there is nothing wrong with him. Sorry for going on and on this has been such a emotional drain on my life. Thank you everyone here. your support has helped in more ways than you know.
