    Default How Long Do Lawyers Work on Cases Before Filing for a Lawsuit?

    My question involves an injury that occurred in the state of: CA

    When I got served with court papers telling me that I was going to be sued in the beginning of August - I'm wondering how long ago the plaintiff's lawyer was hired? How long to do personal injury lawyers go through information on a case before they decide to take it and sue?

    (I know it may be different for every lawyer, but is there a standard process all personal injury lawyers choose/or must perform before filing a lawsuit?)

    There is no standard anything.

    What often happens, if there is a physical injury, is the lawyer often waits until nearly the statute of limitations has run so they have the most accurate accounting of damages and the most complete information regarding the eventual outcome of the injuries.

    An attorney could be hired the day of an injury and a suit may not be filed for several years or inversely, the attorney could be hired the day he files suit.

    Thanks! Very interesting, now I am wondering how this might relate to my case...

    If I was served only 14 months after the accident happened, is it likely the plaintiff is no longer seeing a doctor or paying for other damages from the accident that the lawyer could sue for?

    I'm just trying to use logic here and learn more about what might be happening on the other side...

    It's possible but there is no way to tell without discovery to actually be able to see the medical expenses and diagnosis.
