    Question Defending a Frivolous TRO

    My question involves restraining orders in the State of: California

    My neighbor has been making false complaints about my wife and I for over a year. We have had enough of their phone calls to our house and their complaints to various city agencies. All of which we confirmed that we were not in violation of anything. As the calls continued, I decided to speck to them regarding it. I mentioned to them to watch it and that if they do not stop this harrasment, my wife and I would seek leage action. They then files a fivouls tempoary restraining order against me claim I had theatened them with violence. I hired an attorney and during mediation they decided to drop the TRO. However, my wife and I have spent almost $4,000 in attorney fees and court costs to defend ourselves. I am looking for ways to recoup out lost $$$ as the neighbors would not agree to pay the fees in mediation. Should I persue small claims. Do we even have a case. Need advice.

    Gather up all of your documentation and take it to an attorney in your area to see if you have a civil case.

    Small claims is not the appropriate venue - that's for recovering money someone else already agreed to pay you and didn't.
