    Angry Defamation of Character

    My question involves defamation in the state of: California

    I was arrested twice for domestic violence against my spouse once in 2007 and once in 2008 ex-wife wanting to have me in jail so I would eventually not attend hearings and loose custody of my children. Both times I was found not guilty. First time neighbors witness that I did not hit her, but police said it was her word against mine and they had to arrest me. D.A sent me a letter saying no charges would be filed.

    Second time she file a report saying I choked her slammed her to the floor and kicked her when she tried to get up also false, she never called the police until the follwing evening. DA conducted an investigation with local police dept. and filed no charges.

    The above caused me a lot of mental stress and money I am not a woman/wife beater. In order to maintain my freedom and ability to show up at each custody hearing in order to not loose my children and not loose my job. Total of 12,800.00 in bail's and legal fees. Want to know if I can sue her for the amount of money it cost me. Thank you for your help.

    I would talk to an attorney & see if they believe you have a case.

    We just went to court in August for final dissolution and custody of our two children. So we are not married anymore.

    My only suggestion is to talk to an attorney & see if they believe you have a case. However, others may still come along with some other/additional suggestions.
