    Default Buying a new house

    I am buying a new inventory house from a builder. One of the sales people verbally told me there would be under cabinet lighting. He also showed me what it would look like in the model home. The signed contract and spec sheet is unclear as to if there should be lighting, however the cabinets are in the house and has a lighting rail. In the spec sheet and contract it states that a lighting rail should be there for the cabinets. In the contract there is no mention of under cabinet lighting in the electricaly section. Therefore, some of the information to have under cabinet lighting is documented in the spec sheet and contract and some is not. The Sales person also gave me an additional piece of paper which had a floor plan and showed the under cabinet lighting. The house is already dry walled, and the builder is refusing to add the under cabinet lighting. Because this would mean ripping out the dry wall. The builder is also saying if it's not in the signed contract then they are not going to do it. What are my options at this time. The builder is Ryland Homes.

    Without the lighting being included in the contract, your options are likely limited. You may wish to consult a consumer protection lawyer to see if any remedies are available to you.

    This issue isn't enough to void the contract because there was no meeting of the minds, an essential element of a contract. I have never purchased a new house before, but I would think that the salesman's workpapers, the ones were he/she worked up the price for the house, would show whether the under cabinet lighting was inlcuded in the price or not. Do you have something to show that the undercabinet lighting was supposed to have been included in the price, so that what you have is a drafting error that the law would usually allow you to correct?
