Default Payment with a Credit Card that Wasn't Activated
My question involves collection proceedings in the State of: Mo

I have a default judgment against me for an old credit card which is fine and I am paying on it but my question is......................

When I 1st applied for the card and received it in the mail the card stated that I had to call to activate it before I would be able to use it. So I never get around to activating the card and eventually forget that I have to do so. I eventually made a payment online to Cingular using this card and apparently it went through w/o me ever activating it. I never used the card again as it would not allow me to since I did not call to activate. I actually did not even know I had a balance on my card because I assumed the payment never processed hence my new default judgment.

Has this happened to anyone?

didn't you receive a statement in the mail for the balance after you used it?

4 months after it was used. And the balance has only gone up since then.

did you get a bill from the credit card stating you had a balance?

If you got a statement with a balance, why did you not pay the balance at that time - it would have eliminated the judgment. The balance has gone up due to interest & late fees.

alright, let's take a step back. You have a default judgment. means you didn't go to court and they won the case. Were you served properly? Did you even know you were being sued?

If you used a credit card issued to you, you owe the money you charged to the card.
