Default Neighbor's New Air Conditioner Illegally Installed?

My question involves real estate located in the State of: California

My Neighbor installed a new air conditioner which is 36" tall within two feet of my property line. We cannot hear our own voices in our living room when it is running.

The city (San Diego) inspected and "finalled" the unit, though it is our understanding it is illegally installed.

    What recourse do we have?

I doubt you have any legal recourse but you might ask him to install a noise blanket.

You can plant shrubs on your side and buy either a better windows for that one area or install a window barrier insulation)

This link addresses your concerns. Although they make a sound blanket sound like an extravagant item (expensive) when it's just foil covered insulation like you see in duct work.

why do you claim it is installed illegally?
I am not an attorney and any advice is not to be construed as legal advice. You might even want to ignore my advice. Actually, there are plenty of real attorneys that you might want to ignore as well.

Thank you so much for your replies!

This air conditioning unit is installed within 2 feet of our property line, measures between 32" and 36" tall, and is new construction. Our review (layman's review) of the building code suggests anything over 30" cannot be installed within 5 feet of the property line.

Our homes are around 8 feet apart. We have antique windows that have to be open in the heat...right when our neighbors run their unit...

then file a comlplaint with the building department and the office that controls the laws in your municipality.

Other than that, it is going to be tough to do anything about it.
