Default Paternity Case Between UK and Canada
My question involves paternity law for the State of: either UK or Canada! not entirely sure.

My partner who lives in the UK is currently involved in a paternity case situated in Canada. The mother and daughter live in Canada and she filed for this case many years ago. My partner has continuously refused to have a paternity test as he was told it costs thousands of pounds. His lawyer told him that there was nothing they could do and it would eventually be written out of court anyway.

What i would like to know is:
How much would a paternity case be between these two countries?
Of which law does the case lie in? UK or Canada?


He believes he is not the father and when she said she was pregnant, he refused to be the childs father and she continued to have the child anyway.
Is there any declaration that the father can sign to say that he wishes NOT to be the childs father? Even if, it turns out he is the father?


Any ideas, examples of something similar anyone?

The case lies in Canada.

You would do well to address your queries to a site specializing Canadian law.

Thanks for your help, i found this on the children rights council for Canada:

What is pro-choice for men in Canada?
Pro-choice for men in Canada is similar in many ways to pro-choice for women. It is the "next best equal legal position available" to men in the case of a woman becoming pregnant. At or before birth, as may be practical under law, a man would make a legal declaration in response of his choice to become a parent to a specific pregnant woman after mandatory government paid paternity testing. This declaration of his choice to become parent or not become a parent would be legally binding.
The man's declaration would be a response to a woman's legal declaration stating that she is pregnant and that she believe that man to be the potential father served on him.
The man could then make the choice of becoming or not becoming a parent to that child and if he chooses to become a parent would be entitled to a relationship with that child and provide or receive financial support for the child, as the case may be, as determined by the provincial, territorial and federal acts concerning family law, custody and child financial support.
The Canadian Children's Rights Council advocates for legally binding declarations of the choice of both potential parents to become parents when a woman becoming pregnant.




I have emailed canadian children rights council to see if they could explain this further. As far as i can see, however, it states that the father can not become the father and therefore not financially support the child....
