    Default Gas R.O.W's and Easements in Texas

    I live in a small rural Denton county town and was met by ROW agents from the gas company today. We don't own mineral rights on the property and there is currently a 50' easement running through the property. The ROW agents informed me that the would have crews in the area with seismic equipment for exploration purposes, as I'm sure may of you know these guys can be very pushy. I have seen these guys before and they run wires all over the place and drive all over your property destroying pasture and hay fields.

    These guys already came through once a few years ago to replace a pipe line on the property and tore everything to sh*t and left there trash behind among other things. After trying to work with these guys last time and being treated the way I was I intend to stand my ground his time being that it's evident if you try to be a nice guy they will walk all over you.


    My question(s) are in regards to my right as to what they can and cant do.

    They can assert whatever rights they have under the easement.

    If they exceed their rights or leave trash, you can seek an appropriate remedy. Complain to their boss, small claims court... it depends on what happens.

    I understand that if they have an easement, they can do what they need to within the easement. The problem here is that they are going to be all over the property installing sensors in the ground for their seismic equipment. This is for exploration purposes, not maintance on the 50' easement purposes.

    I am not sure what the laws in TX are, but in California, mineral owners have rights that supersede those of the surface owner. Damages to land and crops would have to be recompensed and generally most companies will recompense you for any inconveniences. But like I said, I have no clue of TX laws. You probably want to at least consult with a local attorney and find out what your options are. It is money well spent.
