    Default Vehicle Title Issue on a Repo from an Ex in Texas

    My question involves vehicle registration or title in the state of: Texas.

    A long time ago I co-signed on a vehicle with a girlfriend. About two years after, she left and went back to her home town. About a year after, she began being late on her car payments. The company that financed the car was not able to get a hold of her and began calling me. At first she was 30 days late and I told them to keep calling her because I did not have the car. She got the car payemt caught up. Then I received a call that she was 60 days late on the car and they were having a hard time getting a hold of her. The company told me that if she became 90 days late, they were going to repo the car. I freaked out and tried everything I could to call her and tell her to get current or they are going to repo the car. They finally came to an agreement to set up a payment plan in order for her to catch up. She was unable to adhere to the agreement and I got one last call from the finance company saying that she had not met the terms of their agreement and that they were going to reposses the car.
    I told them not to do it and that I would go and get the car and once in my possesion, I would bring the payments current. I drove to her home town and repo'd the car on my own. She called me and told me that the car was repo'd and she didn't know what to do. I told her that I repo'd the car and that she could have it back for the remaining balance on the loan. I told her that she had already messed up my credit with late pays on the car and that I refused to have a repo on my credit. She did not care and wanted the car back. I spent $1500 to get the payments current and told her that she would at least have to come up with that cash to have the car back. She didn't feel that she needed to do that so I told her I was going to sell the car for what was owed, plus the money I spent to get current.
    Now I am stuck trying to sell the car and she is no where to be found. Both of our names are on the title and I want to sell the car. I've tried talking to TXdot and they were not very helpful. What can I do on my own to transfer the title without having her around to sign over the title?

    Are we to assume that she's the sole owner on the title? That you don't have a lien recorded on the title, but are merely a cosigner? Then you have no right to possession. Your remedy is to sue her for the money you pay to cover her missed payments.
