Default Claiming Exemptions
My question involves collection proceedings in the State of: california

a lot of posts here mention exemptions, what is or is not exempt as far as wage garnishments, property, value of cars, etc. it made me wonder if the creditors would still try and get clearly exempt property and leave it to us to go to court to defend it or get it back. ie. say you just have social security deposited in your checking acct nothing else, and have a balance could they seize it and force you to go to court to get it back? also wage garnishments in some states head of houehold is exempt for certain amount. would they still garnish, and force you to dispute? i guess what i am asking, is even though something is clearly exempt from garnishment or seizure, doesnt mean they would not try and take it and force you to get it back. correct?

Default Re: Claiming Exemptions
I would not expect a creditor to pursue exempt property. However, I cannot predict the future and know nothing about your circumstances.
