My question involves a child custody case from the State of: Texas
My son is 11 years old, I am divorced and have the sole managing conservator rights, the father has visitations rights. Which he has not followed in the past year and a half no phone call or any type of contact has been received by him (as if he vanished). He is current on his child support payments since they are withdrawn automatically from his employement. I have remarried and we are both stable individuals my current husband wishes to adopt my son since the father is not around. (violation of the court order)
The biological father has not provided with a current phone or address and the CPS will not provide me with one to attempt finding him to maybe give his rights up.
If I file for termination of right under parent disinterest what are my odds?
Or what can I do to get full custody or have the bio fathers right terminated since he has not followed the court order and my son does not wish to see him.
