Default Paternity of Child Born 3 Months After Divorce, Ex-Husband Not the Father
My question involves paternity law for the State of: New York

I posted recently about my upcoming divorce, asking how I could establish that the child I'm pregnant with now (due in early December) is my fiancé's and not my ex-husband's. The trial was today, the divorce went through, and my ex acknowledged in court that he is not the father of this baby. Now, is it sufficient for my fiancé to file an acknowledgement of paternity after the birth, or will my ex need to sign that as well, or will we need to go to court again? Thank you!

You can't unilaterally assert paternity. If your ex- won't sign, you need to file a paternity lawsuit.
