    Default Right of Way in Neighborhood

    In our West Virginia community, dividing our home at the top of the hill and the other houses is a right of way. It is not owned by anyone in particular. Part of this turnaround is connected to our driveway and is used as a turn around. We have always maintained this piece of property and have even paved it this past year. We are now having issues with some of the neighbors who are missusing the property. My question is who legally owns this property and do we have legal rights since we have maintained this property?

    The land is owned by somebody. As it's a community, it may be platted. Check the maps or plats created for the community to try to determine ownership, and intended use.

    Your belief that other property owners are "misusing" the property does not, of itself, give you any right to exclude them. If you have a homeowner's association, you should be able to take up the misconduct with the HOA.
