Default Request for Admissions, Docs, Interrogatories
My question involves collection proceedings in the State of: Mass.
I answered a summons basically stating that I wanted strict proof of the debt and amount owed. A week later I got a very involved "boilerplate" Request for documents, interrogatories and admissions.
For one thing I have no docs to speak of, not even the credit card. All I'm really interested in is seeing proof that this is mine, and how they came up with the final amount. I know if I don't answer I'll get a judgment, but how do I answer? They want each and every statement, check I used to make payments etc. etc.. And if I don't have something they want to know how, by whom, when and why these docs were destroyed.

NOt only don't I have anything, I feel that these are the things they should be showing ME to prove it's my debt.

You were supposed to ask for proof that this was yours when you received the first collection letter. At this point, the debt is assumed to be valid.

I never received a first collection letter. They may have tried calling but we don't answer the phone if it's an unknown number.

That's your fault.

Just as an example, the company I work for, although we are a 100% legit company, and we don't do collections, our number shows up private because of the way our phone system works. Had you answered the phone, you would have known about this debt. Legit companies show up as unknown on the phone system. Especially when you're already on the do-not-call list, you shouldn't receive a single call from someone/company that you're not expecting in some fashion.
