    Default Grand Larceny, Class E Felony, in NYC

    My question involves criminal law for the state of: New York

    I lost my finance job 6 months ago and my father 3 months ago and have been suffering depression. Two days ago I received a preliminary eviction notice. Bottom line story:

    I was caught shoplifting in a department store, the amount was $1,005 so I was charged with Class E Felony, Grand Larceny instead of a misdemeanor. I thought I'd be able to sell it to pay a portion of the rent.

    I was released within 2 hours from the holding cell because I had no priors and they set the court date without having to go to central booking.

    a) What are the odds of jail time?
    b) What will the fine likely be? - I ask that because obviously I was taking the items to avoid bankruptcy and eviction - so a fine may be counterproductive especially since I may have to declare bankruptcy anyway... I'm willing to do as much community service as possible to make up for the fine value... as I am starting to work again soon and trying to get back on my feet financially...

    a) Shoplifters - even felony shoplifters - don't usually go to jail, but that is really all anyone can tell you on that score. There's no guarantee you won't get put in jail for a while.

    b) Unknown.

    You may qualify for an Adjournment Contemplating Dismissal. Show up for court, plead not guilty and ask for a Public Defender. Work with your PD for a decent plea agreement and an ACD, and you may well not have any fine at all (no guarantees).
