Default Texas statute of limitations for paternity
What rights do I have if an ex-girlfriend asks for a DNA test to prove paternity on a 13 year old child she gave birth to after married to another man? His name is on the birth certificate and is currently paying child support. When I asked about the child 13 years ago I was told he wasn’t my child and that do bother them again. She had a husband and the time frame matched what she said so I left it alone. Now she is divorced, remarried and is asking for a DNA test because of medical problems the child is having. I don’t want to cause the child any problems but I also want to know my rights for my defense if this isn’t all she wants the test for.

Default Paternity Action
Her ex-husband may have grounds to oppose the petition. But sorry - you're not going to get out of a paternity action on "statute of limitations" grounds while the child is still a minor.

What can they do if I do agree to a test and it is positive? And I liable for 13 years of child support. I was told this wasn’t my child back when he was less than a year old, had a dad and what I thought was a happy family. She claims the test is just for medical purposes to help build a medical back ground for the doctors who a re helping the boy. Can they come after me for child support (past and future)? I want to help the child if I can but am in no situation to pay child support for a child that I do not know. Any help is appreciated.

Default it depends!!
They can not get you for back child support. She was married, your NOT on birth certificate..Now as for future child support: ONLY if the husband gives up his rights to the child, can she get child support from you. 2 men cannot be ordered child support for 1 child. How long have they been divorced? See, if statue of limitations runs up for him to contest, he is pretty much "the dad" and the fact that they were married when child was born supports that fact. It would take a lot of money for her or him to get anything from you. Do you know if he wants to give up his rights to child? If not, your in the clear. Even if he does, check out statue of limitations..You should be fine, though..

Default After 17yrs without knowing
We are going through the same problem. My husband was approach by a lady after 17yrs and was told that he was the childs dad and she wants him to pay support. my husband asked her why did she wait 17yrs to tell him that he was the father of this child. Will she be able to collect back support from us if the child turns out to be my husband. He was not aware that he had a child by this woman and at that time she was married and put the child in her husbands name. she claims that the name for the father was left blank. can she make us go back to day one to pay support? thanks
